CONSTITUTIONAL LAW

Holding: Protection from being murdered is not constitutionally guaranteed
hence not actionable. Therefore the court erred when it confined the scope
of early summary judgment proceedings to whether or not there was a causal
link between the conduct of a deputy and the policies of a police
department and the murder of the Petitioner. The proper inquiry was as to
equal protection under the law.
