Shooting ruled justifiable homicide

Randolph County Coroner David Haley has ruled the death of a 24-year-old
Moberly man a justifiable homicide after finding the shooter acted in
self-defense on Wednesday night.

Orville Harry Ervin was shot to death Jan. 30 after an argument with
another person at 21 McCormick St., Moberly.

According to a police report, Ervin left the residence and later
returned to the home with a knife and threatened a 23-year-old subject.
Ervin was shot by the subject three times before turning and collapsing
in the commons area of the residential complex in the area of 19
McCormick.

Officers have recovered a firearm thought to be involved in the shooting
along with a knife that had reportedly been wielded by the deceased
subject.

Investigators spent the day Thursday interviewing family members and
neighbors who witnessed the incident. A Moberly Police Department report
said that numerous citizens came forward and helped officers with the
investigation allowing for a speedy resolution of the investigation.

The 23-year-old man who was involved with the shooting was released from
custody Thursday after it was ruled that the shooting was an act of
self-defense.

Authorities would not release the subject’s name. Randolph County
Prosecutor Michael Fusselman said that no charges would be filed.
