A grand jury rules that Paciano Reyes-Vieyra acted in self-defense in
the shooting death of Esterbol Rios-Gomez Oct. 18 in Hawthorne Circle

WOODBURN, OREGON — A shooting that left a Woodburn man dead in the
middle of Hawthorne Circle will result in no criminal charges.
A Marion County grand jury returned that decision after hearing the
evidence in the case that left Esterbol Rios-Gomez shot to death Oct. 18
in the 3000 block of Hawthorne Circle, Woodburn.
The grand jury determined the shooting was not criminal and that the
shooter, Paciano Reyes-Vieyra, had killed Rios-Gomez in self-defense.
The incident began at approximately 3:10 a.m. Oct. 18 when Woodburn
Police officers responded to a call of an armed subject at 3471
Hawthorne Circle. When police arrived, the subject, later identified as
Rios-Gomez, had fled.
Residents in the house told officers that Rios-Gomez had a knife and was
threatening to kill the homeowner, Reyes-Vieyra, and his family if the
demands he’d made were not met.
According to police, Rios- Gomez was demanding that Reyes-Vieyra contact
his former girlfriend, Sabrina Contreras, and have her come to Hawthorne
Circle.
Officers continued to search for Rios-Gomez, but were unsuccessful.
WPD officers returned 25 minutes later when Contreras arrived at the
home, at approximately 3:35 a.m., and took her statement. According to
police, they left the residence at about 4 a.m. and continued the search
for Rios-Gomez.
Five minutes later a 911 call placed from Contreras had police racing
back to Hawthorne Circle. Rios-Gomez had returned to the residence and
was again threatening to kill Reyes-Vieyra and his family. During his
assault, Rios-Gomez threw bottles through the windows of the residence
and then kicked in the door of the home, all the while continuing his
verbal threats.
Police responded to the home for the third time, at approximately 4:10
a.m. As officers were en route to the call, they received word that
shots had been fired.
Police arrived and found Rios-Gomez in the street suffering from gunshot
wounds. Reyes-Vieyra admitted to police that he had shot Rios- Gomez to
protect himself and his family.
Rios-Gomez was transported to Salem Hospital where he was pronounced
dead on arrival. Cause of death was gunshot wounds to the abdomen and
chest.
Woodburn Police Department detectives and officers, along with
detectives from the Oregon State Police, the Marion County Sheriff’s
Office, and the Salem Police Department spent the next few days
interviewing witnesses and neighbors about the shooting. Additionally,
the Oregon State Crime Lab and an Oregon State reconstruction team
responded to assist with the investigation.
The case was submitted to the Marion County grand jury earlier this
month for review. After examining the physical evidence and hearing from
a number of witnesses, the grand jury returned its findings —
