ANDERSON, S.C. (AP) – Prosecutors say they will not charge a man who
shot and killed an ax-wielding intruder in his bedroom.
Lance Myers of Anderson acted in self-defense when he shot 41-year-old
Ernest Leroy Miles, Prosecutor Druanne White said.
Myers told police he pulled a handgun from his nightstand and shot Miles
in the neck after spotting an intruder coming at him with an ax on March
7.
White said she reviewed the evidence in the case and compared it to what
Myers told investigators. “Everything the victim told us ended up
panning out,” she said.
The intruder apparently grabbed the ax from among Myers’ tools at the
base of the stairs in the house, she said.
Under South Carolina law, the break-in gave Myers the right to shoot in
self-defense as long as he reasonably feared bodily harm or death and
had not instigated the attack, she said.
