Utah Legislative Update — February 10, 2000

The Good News: Your letters, faxes, e-mails, and postcards are
working! Thanks to you, HB 174, Public Safety Fee Increases (Chard)
was killed in the House yesterday. Let’s hope it stays dead! If you
remember, this one would have raised fees for background checks on
law-abiding gun owners (another way of penalizing you for exercising
your rights). But more, it would have removed the ability of the
legislature to keep the Dept. of Public Safety and Governor “Gun
Control” Leavitt in check. Now we need to work on eliminating these
unconstitutional fees altogether. We need to stay alert so this one
isn’t resurrected.

The Rest:

HB 95 — The Jones-Leavitt plan for BRADY REGISTRATION OF PRIVATE
SALES of guns at “gun shows” was in Committee today — no news as of
this printing. (See also HB 161 below)
Action — TBA.

HB 161 — Another Leavitt plan for BRADY REGISTRATION OF PRIVATE
SALES of guns at “gun shows.” Now in Senate Rules Committee.
Action — call your Senator and Rules members and tell them to
oppose

HB 176S3A — MENTAL HEALTH KANGAROO COURT bill. Removes
“immediate danger” clause, opening up a whole new slew of
restrictions on you. Requires reports to BCI of even misdemeanor
offenses and civil commitments. Now in the Senate Judiciary. GOA
will let you know when this anti-gun bill gets a hearing date.
Action — call your Senator and the Judiciary members and tell
them to oppose.

HB 199 — THE GUN LAWSUIT PROTECTION bill, has passed the House
and is in Senate Rules now.
Action — call your Senator and Rules members and tell them to
support.

HB 245 — the “NO SAFETY IN PUBLIC SCHOOLS” Act, is scheduled for
a 3rd reading in the House. Not only will this bill treat a child
with a toy gun as a violent criminal, but it opens the door to
Federal funds, allowing anti-gun feds to call shots in your local
affairs.
Action — call your Representative and tell them to oppose.

SB 72S2A — as PREVIOUSLY rewritten, called for unconstitutional
ex post facto (after the fact) penalties — holding juvenile
offenses against people in order to deny gun rights, and creating a
separate second class of citizen — the gun owner. Anyone
dishonorably discharged from military service (i.e. Michael New) for
even political reasons would permanently lose their 2nd Amendment
rights, and anyone in possession of a firearm and even an unusable
amount of marijuana (such as a seed) would also permanently lose
their gun rights.
Now it has been reworked a second time — it is now a mini-novel
that affects many different sections of Utah code. The obvious
tactic here is to cloud the true meaning of the bill and discourage
people from reading it — but don’t be fooled — it still does the
things mentioned above, plus, ominously enough, it removes the word
Criminal from the Bureau of Criminal Identification, renaming it the
Bureau of Identification (a little closer to the truth). ** Note: a
second similar bill has been introduced (SB 200) that needs to be
opposed as well.**
Action — call your Senator and tell them to oppose.

Please call about the whole slew of bills above right away. Leavitt
and his anti-gun cronies are twisting a lot of arms and counting on
the pro-gun community to wear down and lighten up our opposition –
don’t let these gun grabbers strip you of your rights. Only YOU can
save your Right to Keep and Bear Arms.
