instead of putting restictins on guns that ONLY affect law abiding criminals, why dont’t they PUNISH the CRIMINAL !!!!!!!!!!!!!!!!!!!

Bail granted to man charged in boy’s death

The man accused of killing an eight-year-old boy by firing a bullet
through the child’s bedroom ceiling has been granted bail.

In September, Brian Daniel, 29, was denied bail in Ontario Court of
Justice.

That decision was overturned yesterday in Superior Court.

Daniel was released on a $10,000 no-deposit bond and must stay away from
the apartment complex where his parents and the victim lived.

Jordan Smith was shot around 1 a.m. on Sept. 10 as he slept in his bed
in his mother’s second-floor apartment.

Evidence at the bail hearing and reasons for Justice Anne Tucker’s
decision are under a publication ban.

Daniel is charged with criminal negligence causing death, manslaughter
while using a firearm and other firearms charges.

Under the terms of his release, Daniel must live with his grandmother in
St. Catharines and be under curfew from 9 p.m. to 8 a.m. daily.

Daniel has been in custody since being arrested Sept. 11.

Police said the bullet that killed Jordan was fired in the apartment
above from a .45-calibre semi-automatic pistol.

The bullet punched through the floor and hit the boy in the back.
