Looks like a clear cut case of Self defense to me !

NOTE:
1. A driver who cuts you off, gets out of his car and comes back to
smash in your driver’s side window is definitely out of control.
2. That window is about 12 inches away from your head – it’s
reasonable to assume the attacker smashed the window because he’s trying
to get at you intending you harm.
3. Firing 4 or 5 shots is not suspicious – any police or defensive
pistol training says to keep shooting until the attacker is stopped
(this is why police shootings often involve the bad guy getting shot 6
or 8 times). You can fire 4-5 shots in less than 2 seconds.
4. Again, standard advice in any CHL or defensive pistol class is
to say, “I’m sorry officer, I want to answer your questions, but given
the seriousness of the situation, I must decline to do so until my
lawyer is present”.

Traffic dispute turns deadly at intersection

A motorist was shot to death in what police are calling an apparent case
of road rage near a busy southwest Houston intersection Wednesday night.

The incident occurred in front of other motorists driving by and people
waiting for a bus at Richmond and Shepherd around 6:45 p.m.

Witnesses said a man driving a Mercedes-Benz cut off a Honda sport
utility vehicle, then got out on Richmond, walked back to the Honda and
broke out the driver’s side window, said homicide investigator Freddy
Mares.

The man driving the Honda, who has a permit to carry a concealed
handgun, fired the weapon four or five times, striking the motorist who
had confronted him, Mares said. The wounded man, whose name was not
immediately released, died in Ben Taub Hospital.

The shooter was detained at the scene by police, and his attorney showed
up to assist him.

The gunman declined to give police a statement on what led to the
shooting. Police expected to refer the case directly to a grand jury,
which will determine whether the shooting was a valid case of
self-defense.
